File No. 08 — Legal

Terms of Use (EULA)

Effective date — August 8, 2026

This End User License Agreement ("EULA") is a legal agreement between you and Batuhan Demir, operating EnigmaDeck — not with Apple Inc. or Google LLC — governing your use of the EnigmaDeck mobile app. By downloading, installing, or using the app, you agree to be bound by this EULA.

Section 1

Acknowledgment

This EULA is between you and the Developer only, not with Apple or Google. The Developer, not Apple or Google, is solely responsible for the app and its content. Where the app is downloaded from the Apple App Store, this EULA incorporates the minimum terms set out in Apple's Licensed Application End User License Agreement (Schedule 1 of the Apple Developer Program License Agreement), which take precedence over any conflicting term below with respect to Apple-distributed copies of the app.

Section 2

License Grant

Subject to your compliance with this EULA, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the app on Apple- or Android-branded devices that you own or control, and as permitted by the Apple App Store Terms of Service or Google Play Terms of Service, solely for your personal, non-commercial use.

You may not: (a) copy, modify, or create derivative works of the app; (b) reverse-engineer, decompile, or disassemble the app, except to the extent applicable law expressly permits; (c) rent, lease, lend, sell, redistribute, or sublicense the app; (d) remove or obscure any proprietary notices; or (e) use the app for any purpose not expressly permitted here.

Section 3

Your Account

You are responsible for maintaining the confidentiality of your login credentials (Google, Apple, or guest session) and for all activity under your account. Notify us promptly at [email protected] of any unauthorized use.

Section 4

Maintenance and Support

We are solely responsible for providing maintenance and support for the app, to the extent required by applicable law. Apple and Google have no obligation whatsoever to furnish any maintenance or support services for the app.

Section 5

Warranty Disclaimer

To the maximum extent permitted by applicable law, the app is provided "as is" and "as available," without warranty of any kind, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

In the event of any failure of the app to conform to any applicable warranty, you may notify Apple or Google, and Apple or Google (as applicable) will refund the purchase price, if any, for the app to you; to the maximum extent permitted by applicable law, Apple/Google will have no other warranty obligation whatsoever with respect to the app, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be our sole responsibility, as governed by this EULA.

Nothing in this section limits any statutory consumer-protection rights you have that cannot be waived or limited by agreement under the law of your country of residence.

Sections 6–7

Product & Intellectual Property Claims

We, not Apple or Google, are responsible for addressing any claims by you or any third party relating to the app or your possession and/or use of it, including: (a) product liability claims; (b) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation. The app does not use HealthKit or HomeKit.

We, not Apple or Google, are responsible for the investigation, defense, settlement, and discharge of any claim that the app or your possession and use of it infringes a third party's intellectual property rights.

Section 8

Legal Compliance

You represent and warrant that (a) you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.

Section 9

Third-Party Beneficiary

You acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of this EULA, and that, upon your acceptance, Apple has the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary of it.

Section 10

Virtual Items

Coins, premium tiers, cosmetics, and other virtual items are licensed, not sold, to you. This license terminates when your account is deleted or terminated.

Section 11

Termination

This EULA is effective until terminated. Your rights under this EULA terminate automatically, without notice, if you fail to comply with any term. Upon termination, you must cease all use of the app and delete it from your devices. Sections 5–9 and 11–13 survive termination.

Section 12

Governing Law

This EULA is governed by the laws of the Republic of Turkey, without regard to conflict-of-law principles, except that if you are a consumer habitually resident in the EU/EEA or UK, the mandatory consumer-protection laws of your country of residence apply in addition and take precedence over any conflicting term here.

Section 13

Contact

Batuhan Demir — [email protected]

A registered legal notice address is not yet published here — {{LEGAL_ADDRESS}} — it will be added as this document is finalized. Apple's Licensed Application EULA minimum terms name a developer address as a required element of any custom EULA; until then, contact us by email above.
Section 14

Google Play Note

Where the app is distributed via Google Play, this EULA is between you and the Developer only. Google Play's own Terms of Service apply to your use of the Google Play Store itself and govern independently of this EULA.
